General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) govern the contractual relationship between Crea Bars GmbH, Fennergasse 5, 8008 Zurich, Switzerland (hereinafter "Crea Bars") and its customers (hereinafter "Customer") for all orders placed via the online shop (www.creabars.ch, www.creabars.com). These GTC apply exclusively to consumers. Separate provisions apply to commercial business relationships with resellers (e.g., gyms).

 

2. Contracting Parties and Conclusion of Contract

The Customer’s contractual partner is Crea Bars GmbH. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button ("Buy now" or similar), the Customer places a binding order for the goods contained in the shopping cart. By placing the order, the Customer acknowledges the validity of the currently applicable GTC of Crea Bars. The contract is concluded when Crea Bars accepts the Customer's order by sending an order confirmation via email immediately after receipt of the order.

 

3. Prices and Payment Conditions

All prices in the online shop are quoted in Swiss Francs (CHF) and include statutory Value Added Tax (VAT). Any shipping costs incurred will be charged additionally and displayed transparently during the ordering process. Payment is made using the payment methods offered during the ordering process (e.g., Credit Card, TWINT).

 

4. Retention of Title

The goods remain the property of Crea Bars GmbH until the purchase price has been paid in full.

 

5. Delivery and Shipping

Crea Bars currently delivers exclusively to shipping addresses in Switzerland. The stated delivery times (e.g., 5-10 working days) are guidelines and are not binding. Delays may occur, particularly in the event of high order volumes or delivery bottlenecks at suppliers. Crea Bars will inform the Customer of any delivery delays.

 

6. Right of Withdrawal

There is no general statutory right of withdrawal or return for online orders in Switzerland. As Crea Bars are food products, they are generally excluded from return or withdrawal for reasons of health protection and hygiene.

 

7. Notice of Defects and Warranty

The Customer is obliged to inspect the delivered goods for defects and completeness immediately upon receipt.

  • Transport damages: Visible transport damages must be reported immediately to the carrier (e.g., DHL, Swiss Post).

  • Other defects: Defects that are not attributable to transport must be reported to Crea Bars in writing (via email to info@creabars.com) within 5 working days of receipt of the goods, stating the order number and a description of the defect.

If the notice of defects is late, warranty claims are forfeited. Crea Bars provides a warranty in accordance with the provisions of the Swiss Code of Obligations. In the event of a defect, Crea Bars shall decide between a replacement delivery or a refund of the purchase price.

 

8. Exclusion of Liability

Crea Bars excludes liability for slightly negligent breaches of contract. This limitation of liability does not apply to direct damages resulting from injury to life, body, or health that are directly caused by Crea Bars. Liability for indirect damages, consequential damages, or lost profits is excluded to the full extent permitted by law. Liability under the Product Liability Act remains unaffected.

 

9. Product Information and Health Disclaimers

The product information provided on www.creabars.ch serves solely for personal information; it does not constitute professional medical advice or diagnosis. Health Note: The products contain creatine and may contain allergens (see ingredient list). Persons with known allergies, pre-existing conditions, who are pregnant, or who are taking medication should consult a doctor before consumption. The products must be kept out of the reach of children.

 

10. Protection of Minors

The offer of Crea Bars is directed expressly at customers capable of judgment who have completed their 18th year of age. As the products contain creatine, the intake of which is not recommended for children and adolescents in the growth phase without medical consultation, Crea Bars requires legal adulthood for the conclusion of the contract. By submitting the order, the Customer bindingly assures that they are at least 18 years old and fully legally competent. Crea Bars reserves the right to request proof of age in cases of doubt or to cancel the order without giving reasons. Crea Bars assumes no liability for orders placed using false information (e.g., date of birth) or by minors without the consent of their legal representatives.

 

11. Data Protection

The handling of personal data is regulated in the separate Privacy Policy, which is an integral part of this contract.

 

12. Final Provisions

Should individual provisions of these GTC be or become ineffective or incomplete, the legal validity of the remaining provisions shall remain unaffected (Severability Clause). The contractual relationship is governed exclusively by Swiss Law, excluding the UN Sales Convention (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of Crea Bars GmbH: Zurich.
